NAVIGI GmbH - GENERAL TERMS AND CONDITIONS (GTC)

 

It should be noted in advance that all gender-specific terms are to be understood as neutral and that the use of only one form is solely for better readability.

 

§ 1 Scope

(1.1) The general terms and conditions set out below apply to all transactions between the customer and NAVIGI www.navigi.at concluded contracts and are therefore the basis for both the relevant conclusion and the corresponding processing.

(1.2) Any conditions set by the customer that deviate from this will not be recognized unless NAVIGI has given express written consent.

 

 § 2 CONCLUSION OF CONTRACT AND DELIVERIES OF GOODS

(1.1) Those on the website www.navigi.at The advertised offers merely represent non-binding offers to make an offer on the part of the customer and are aimed exclusively at consumers within the meaning of the KSchG.

(1.2) The legally binding order in the sense of an offer to purchase the items in the shopping cart is made by the customer clicking on the “Pay Now” button, whereby NAVIGI confirms this by email immediately after receipt.

(1.3) By placing his order, the customer declares that he is acting exclusively for private purposes.

(1.4) If the purchase represents a company-related transaction within the meaning of the UGB and is therefore attributable to the customer's commercial or professional activity, please contact NAVIGI separately, otherwise NAVIGI expressly reserves the right to withdraw from the contract.

(1.5) The contract is then concluded when NAVIGI accepts the customer's order, which occurs either by sending the goods or by sending an express declaration by email.

(1.6) NAVIGI expressly reserves the right to refuse or cancel an order.

(2.1) Contractual partner for orders via www.navigi.at is the capital company NAVIGI GmbH, recorded in the commercial register of the regional court of Innsbruck (Austria), under the commercial register number FN 609587, located at AUT - 6141 Schönberg im Stubaital, Brennerstraße 1 (see imprint).

(2.2) The contract is concluded exclusively in German.

(2.3) Austrian law applies exclusively to all contracts, excluding conflict of law rules and the UN Convention on Contracts for the International Sale of Goods.

(2.4) For any disputes arising from all contracts, the competent court in Innsbruck is expressly agreed upon.

(2.5) The customer hereby expressly agrees to the assignment of all NAVIGI GmbH claims against him to third parties.

(2.6) The purchase contract items remain the property of NAVIGI until the purchase price has been paid in full.

(2.7) Should individual provisions of these General Terms and Conditions be or become ineffective, this will not affect the effectiveness of the remaining provisions..

(3.1) Orders will initially only be delivered within the European Union to certain countries that are declared in our shipping information.

(3.2) Depending on the delivery location, the delivery time is usually 2-5 working days and will be announced during the ordering process. With the exception of public holidays, all days from Monday to Friday inclusive are counted as working days. However, this deadline is only intended to represent a guideline and NAVIGI expressly reserves the right to extend this deadline accordingly.

 

 § 3 PRICES, SHIPPING COSTS AND SPECIAL SHIPPING

(1.1) The prices last listed at the time of ordering apply. These are final prices and therefore include the applicable statutory sales tax.

(2.1) For orders to the available countries, shipping costs from a purchase price of EUR 29.90 will be borne by NAVIGI using the usual shipping method and are therefore free.

(2.2) For orders under an amount of EUR 29.90, shipping costs of EUR 6.90 including statutory sales tax will be charged.

(4.1) For certain orders, NAVIGI offers the option of express or long-distance shipping and, if available, the possible shipping method is shown separately for each order, as is the respective surcharge.

(5.1) In the event of a return of goods, the relevant delivery costs must be borne by the customer.

 

 § 4 PAYMENT

(1.1) NAVIGI offers various options for paying the purchase price, which include payment methods in advance, credit card, PayPal, instant transfer, invoice and many more. However, NAVIGI expressly reserves the right not to offer certain payment methods and to refer to other payment methods.

(2.1) If the purchase is made using a credit card, the credit card account will be debited immediately after the customer places the order.

(3.1) The statutory default interest applies.

(4.1) Any transaction costs are borne exclusively by the customer.

(5.1) The customer hereby expressly agrees that he will receive invoices and credits exclusively in electronic form.

 

 § 5 PROMOTIONAL VOUCHERS AND THEIR REDEMPTION

(1.1) Promotional vouchers are issued as part of advertising campaigns with a specific period of validity and cannot be purchased.

(1.2) These can only be redeemed within the specified period and only once as part of an ordering process. These can also be tied to a certain minimum order value. Individual items may be excluded from the respective promotion and the use of such vouchers to purchase gift vouchers is excluded without exception.

(1.3) The value of the goods must be at least equal to the amount of the promotional voucher and the difference to a higher value of the goods can be offset using the payment options offered. The respective value of a promotional voucher will neither be paid out in cash nor interest. Likewise, the promotional voucher will not be refunded if an item is returned in full or in part.

(1.4) Promotional vouchers can only be redeemed before completing the ordering process and, unless otherwise agreed, cannot be combined with other such vouchers.

(1.5) The promotional voucher cannot be transferred to third parties.

(1.6) When using a promotional voucher as part of a purchase, NAVIGI expressly reserves the right to charge the original price of the goods if the total value of the order falls below the respective value of the promotional voucher due to a cancellation.

 

 § 6 GIFT VOUCHERS AND THEIR REDEMPTION

(1.1) Gift vouchers can be purchased and can only be used to purchase NAVIGI items. Use to purchase additional gift vouchers is excluded.

(1.2) The corresponding redemption must take place before the ordering process is completed.

(1.3) If the balance of a gift voucher is not sufficient for the order, there is the option of making up the difference using the payment options offered. The balance of a gift voucher is neither paid out nor interest.

 

 § 7 STATUTORY RIGHT OF CANCELLATION FOR NAVIGI ITEMS

WHEN PURCHASING NAVIGI ITEMS THERE IS A STATUTORY RIGHT OF WITHDRAWAL:

The customer has the right to withdraw from this contract within fourteen days without giving any reasons. The cancellation period is fourteen days from the day on which the customer or a third party named by the customer who is not the carrier takes possession of the goods or, in the case of partial deliveries, the last delivery. In order to exercise the corresponding right of withdrawal, the customer must contact NAVIGI GmbH, located at AUT 6141 Schönberg im Stubaital, Brennerstraße 1, email:: office@navigi.at, by means of a clear statement (e.g. by a letter sent by post, e-mail or verbally (e.g. by telephone)) of the decision to revoke this contract. The customer can use the attached sample cancellation form. However, this is not mandatory. The customer can also fill out and submit the sample cancellation form or another clear declaration electronically using the contact form on the NAVIGI website. If the customer makes use of this option, a confirmation of receipt of the revocation will be sent to them by email. In order to meet the cancellation period, it is sufficient for the customer to send notification of the exercise of the right of cancellation before the cancellation period has expired.

 

Consequences of revocation:

If the Customer withdraws from this contract, the Customer will be entitled to all payments received from NAVIGI, including delivery costs (with the exception of additional costs resulting from the Customer choosing a method of delivery other than that offered by NAVIGI). has chosen standard delivery), immediately and at the latest within fourteen days from the day on which notification of the cancellation of this contract was received by NAVIGI. For this repayment, NAVIGI uses the same payment method that the customer used in the original transaction, unless something different was expressly agreed with the customer. In no case will the customer be charged any fees for this repayment. However, the refund can be refused until NAVIGI has received the goods back or the customer has provided evidence that they have sent the goods back, whichever is earlier. The customer must return or hand over the goods to NAVIGI (see delivery address below (ATTENTION: NOT TO OUR HEADQUARTERS)) immediately and in any case no later than fourteen days from the day on which the customer informed NAVIGI of the cancellation of this contract . The deadline is met if the customer sends the goods before the fourteen day period has expired. The associated return shipping costs must be borne by the customer. If the customer sends the goods to our company headquarters instead of to the location of our logistics provider listed below, the customer will be charged the corresponding delivery costs. The customer only has to pay for any loss in value of the goods if this loss in value is due to handling other than what is necessary to check the nature, properties and functionality of the goods.t.

Attention: The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. Furthermore, you do not have the right of withdrawal for contracts for the delivery of goods that are not prefabricated and for whose production an individual selection or determination by the customer is decisive or that are clearly tailored to the personal needs of the customer.

§ 8 VOLUNTARY RETURN POLICY UP TO 30 DAYS AFTER RECEIPT OF THE GOODS

(1.1) For all purchases made at www.navigi.at, NAVIGI grants a voluntary right of return of a total of 30 days, which goes beyond the statutory right of withdrawal. The customer can therefore withdraw from the contract even after the statutory right of withdrawal (see 7 above) has expired by sending the goods to NAVIGI (see delivery address below (ATTENTION: NOT TO OURS) within 30 days of receipt of the goods (the deadline begins on the day after receipt of the goods). The right of return expressly does not apply to the purchase of gift vouchers or to contracts for the delivery of goods that are not suitable for return due to their nature, such as hygienic reasons.sind.

§ 9 REFUNDS

(1.1) Any repayments will be automatically made to the account used by the customer for payment.

(2.1) If a gift voucher is used for payment, the corresponding amount will be credited to the gift voucher account used.

 

§ 10 LEGAL WARRANTY AND OTHER INFORMATION

(1.1) The statutory warranty claims apply to NAVIGI items.

(2.1) The use of the offers available on www.navigi.at is possible for people who are at least 18 years old.

(3.1) Each customer is only entitled to maintain one customer account. NAVIGI expressly reserves the right to delete multiple registrations.

(4.1) These General Terms and Conditions are made available to the customer before each completion of the ordering process in accordance with the legal provisions and the customer can access this documentf www.navigi.at can also be viewed at any time. In addition, the general terms and conditions underlying the contract can be found in a PDF file in the confirmation email, which NAVIGI sends directly to the customer after the order has been placed.

(5.1) The European Commission provides a platform for online dispute resolution (OS), which can be found under the link to the European Commission platform. NAVIGI is neither obliged nor willing to participate in a dispute resolution procedure before a consumer arbitration board.
